Consumer Rights Act 2015E-Commerce Regulations 2002UK GDPR
In plain English: these terms are the rules for using ITS (In The Shot).
You need to be 18+. If you buy something, standard UK consumer
rights apply — including a 14-day cancellation right for most digital purchases
(see Section 6). If you upload content, you keep ownership
but give us permission to display it on the platform. Questions?

1. Who we are
The Service is operated by [Resonate Studios],
trading as ITS (In The Shot)
,
of [52 Colchester Avenue, E12 5LE, United Kingdom] (“we”, “us”, “our”).
These Terms & Conditions (“Terms”) govern your access to and use of
www.jaysoftware.co.uk
and its sub-paths, including /af/music/ (the “Service”).
By creating an account, making a purchase, or otherwise using the Service, you agree
to these Terms and to our Privacy Policy and
Cookie Policy. If you do not agree, do not use
the Service.
Where you use the Service as a consumer, nothing in these Terms affects your
statutory rights under the Consumer Rights Act 2015 or the Consumer Contracts
Regulations 2013. Where these Terms conflict with your statutory rights, your
statutory rights prevail.
3. Accounts & eligibility
You must be at least 18 years old to create an account or make a purchase. If you are under 18, you may only use the Service with the consent of a parent or guardian.
You must provide accurate information and keep it up to date.
You are responsible for keeping your password confidential and for all activity under your account.
One person, one account. We may refuse or close duplicate accounts.
We may suspend or terminate accounts that breach these Terms (see Section 13).
You may close your account at any time by emailing us. Closure does not affect purchases already made or obligations already incurred.
4. Creator content & licence
If you upload content (tracks, cover art, store listings, podcasts, video URLs, or
similar) as a Creator, you retain ownership of that content. By uploading it, you
grant us a non-exclusive, worldwide, royalty-free licence to host,
store, reproduce, display, and distribute your content within the Service, and to
promote it (for example, by featuring it on share pages or in charts). This licence
lasts while your content is on the Service and for as long as reasonably necessary
after removal for caching, backup, and legal-record purposes.
You confirm that:
You own or have all necessary rights to the content you upload.
Your content does not infringe any third party's copyright, trademark, or other rights.
If your content includes other people's voices, music, or images, you have their permission.
You are solely responsible for clearing samples, mechanical licences, and any royalties owed to third parties (including PRS/PPL, distributors, or publishers).
Important: we do not verify your rights or pay royalties to third
parties on your behalf. If a rights-holder complains about your content, we may
remove it and pass your details to them where legally required.
You indemnify us against claims arising from your content, to the extent permitted by
law (this does not apply to consumer users acting in good faith).
5. Purchases, prices & payment
5.1 Prices
All prices are shown in GBP (£) and include VAT where applicable. Any VAT is shown at checkout.
We may change prices at any time, but changes do not affect orders already placed.
If a price is obviously wrong (for example, £1.00 for a £99 product), we may cancel the order and refund you in full, even after you have paid.
5.2 Payment
Payments are processed by PayPal. By paying, you also agree to PayPal's user terms and privacy policy.
We do not store full card numbers. See our Privacy Policy.
Subscriptions (where offered) renew automatically until you cancel. You can cancel any time via your PayPal account or by contacting us.
5.3 Order confirmation
Your order is accepted when you receive an order confirmation from us (usually by
email or on-screen receipt). We may refuse an order (for example, if we suspect
fraud) and will refund any payment taken.
5.4 Digital content delivery
Digital content (music downloads, licensed tracks, software licences) is delivered
immediately on payment. By starting a download or accessing licensed content, you
acknowledge that you lose your 14-day cancellation right for that content (see
Section 6), as permitted by the Consumer Contracts
Regulations 2013.
6. Refunds & cancellation
Your statutory rights (consumers): goods must be as described,
fit for purpose, and of satisfactory quality. If they are not, you are entitled to
a repair, replacement, or refund under the Consumer Rights Act 2015.
Physical goods (merch): you have a 14-day right to cancel from the day you receive the goods. You must return them in unused condition at your own cost. We will refund within 14 days of receiving the return.
Digital content (downloads, licensed tracks): your 14-day cancellation right is lost once you begin downloading or streaming the content, provided we told you this clearly before purchase (which we do — see Section 5.4).
Personalised goods (custom merch, personalised videos): these are exempt from the 14-day cancellation right once production begins, because they are made to your specification.
Subscriptions: you may cancel at any time; you keep access until the end of the current paid period. We do not refund partial periods except where required by law.
Faulty digital content: if digital content is faulty (for example, a corrupted file), contact us and we will replace it or refund you in full.
Creators earn revenue from sales, plays, and affiliate commissions as described on the relevant plan pages.
Payouts are made via PayPal to the PayPal email on your account. It is your responsibility to keep that email correct.
Payouts are subject to a minimum threshold (currently displayed in your creator dashboard) and are processed in the next monthly cycle after the threshold is met.
We may withhold payouts where we reasonably suspect fraud, chargebacks, or breaches of these Terms, pending investigation.
Third-party fees (PayPal, card processing, currency conversion) are deducted before payout. See the relevant plan page for current rates.
You are responsible for declaring your own income to HMRC. We do not withhold tax except where required by law.
8. Acceptable use
You must not use the Service to:
Upload or share content that is illegal, infringing, defamatory, hateful, or sexually explicit involving minors.
Upload malware, or attempt to compromise the Service's security or the security of other users.
Impersonate another person or misrepresent your affiliation.
Scrape, harvest, or systematically extract data from the Service (including other users' data) without our written permission.
Send spam, chain messages, or unsolicited commercial communications.
Circumvent the licensing, payment, or access-control mechanisms of the Service.
Interfere with other users' use of the Service (for example, by flood-attacking a player page).
We may remove content or suspend accounts that breach these rules.
9. Intellectual property
The Service itself — its code, design, branding, text, and graphics (excluding
content uploaded by users) — is owned by us or our licensors and protected by
copyright and database rights. You may not copy, modify, distribute, or
reverse-engineer any part of the Service except as permitted by law.
The ITS (In The Shot) name and logo are our
trademarks. You may not use them without our prior written consent, except to
refer to the Service factually (for example, "available on ITS (In The Shot)").
If you believe content on the Service infringes your rights, email
legal@jaysoftware.co.uk
with (a) details of your work, (b) the infringing URL, and (c) a statement that
you have a good-faith belief the use is unauthorised. We will investigate and
remove infringing content where appropriate.
10. Third-party services
The Service integrates with third parties including PayPal,
Google (AdSense, Analytics), and social media platforms
(Facebook, X, WhatsApp, Telegram, YouTube, Twitch, Vimeo, Dailymotion). Your use of
those services is governed by their own terms, which you should read. We are not
responsible for third-party services, and we may suspend or withdraw an
integration at any time.
11. Our promises to you
We will provide the Service with reasonable skill and care.
We will handle your data in accordance with our Privacy Policy and UK GDPR.
We will comply with our obligations under UK consumer law.
We do not promise that the Service will be uninterrupted or
error-free, that it will always be available, or that any particular track, artist,
or store will remain available. We may change, suspend, or withdraw features at any
time. Planned maintenance will be announced where reasonably possible.
12. Liability
This section limits our liability. It does not limit your statutory
rights as a consumer, and does not limit our liability for death or personal injury
caused by our negligence, or for fraud.
To the extent permitted by law, we exclude liability for: (a) loss of profit, revenue, goodwill, or anticipated savings; (b) loss of data; (c) business interruption; (d) any indirect or consequential loss.
Where liability cannot be excluded, our total liability to you is limited to the greater of (i) the amount you paid us in the 12 months before the claim, or (ii) £100.
We are not liable for the acts or omissions of third parties (including PayPal, Google, or rights-holders) or for events outside our reasonable control (including internet outages, cyber-attacks, or acts of government).
If you use the Service for business purposes, these limitations apply to the fullest extent permitted by law.
13. Suspension & termination
We may suspend or terminate your account if you breach these Terms, if required by law, or if we cease to operate the Service (in which case we will give reasonable notice and refund any unfulfilled paid orders).
You may close your account at any time by emailing us.
On termination, your right to use the Service ends. Content you have purchased (where licensed, not subscribed) may remain accessible as described on the relevant product page. Sections of these Terms that by their nature should survive termination (IP, liability, governing law) will survive.
14. Changes to these terms
We may update these Terms from time to time. The “Last updated” date
shows when. Material changes will be announced on the Service or by email at least
14 days before they take effect where reasonably possible. If you do not agree to a
material change, you may close your account before it takes effect. Continued use
after the effective date means you accept the updated Terms.
15. Governing law & disputes
These Terms are governed by the laws of England and Wales.
If you are a consumer living in Scotland or Northern Ireland, you may also rely on
the mandatory consumer laws of your home country, and you may bring proceedings
there.
Before starting formal proceedings, please email us at
support@jaysoftware.co.uk
with details of the dispute. We will try to resolve it within 14 working days.
Consumers in the UK may also use the Online Dispute Resolution
platform operated by the European Commission (for cross-border EU disputes) at
ec.europa.eu/consumers/odr.
We are not obliged to participate in ADR.
